Prior to the sentencing, Counsel Rodney Mkweza, representing the state, advocated for a 45-year sentence, emphasizing the severity of the crime. Conversely, Counsel Hanleck Davie Ching’anda of the Malawi Legal Aid Bureau argued for 18 years, citing that Mpaweni was a first-time offender.

During the proceedings, Justice Dick Sankhulani highlighted Mpaweni’s role as a law enforcer, stressing that he understood the implications of his actions involving a minor in custody. Despite acknowledging the need for a stringent punishment, the judge considered Mpaweni’s status as a first-time offender and the fact that he had already lost his job, ultimately imposing a 24-year sentence.

Counsel Ching’anda expressed dissatisfaction with the judgment, maintaining that the sentence contradicted his argument for the lesser penalty. He indicated that he would consult with Mpaweni regarding the potential for an appeal to the Supreme Court.
